Can I report a crime to the District Attorney's Office?

In most cases, crimes must be reported to the police department or other law enforcement agency which has jurisdiction over the city of county where the crime occurred. However, if you wish to call our office we can assist you in taking the correct action.

Edward S. Berberian's name is on my documents, may I speak to him?

The name of the District Attorney of Marin County appears on most court documents just above the name of the prosecutor who prepared the document. In addition, the name of the District Attorney appears on most office correspondence just above the signature of the employee who wrote the letter. The person working on your case is most likely the person who actually signed the court document or letter, and that person is the one you should speak with. With that in mind, when calling ask for the person who actually signed the document.

Where is the District Attorney's Office located?

The District Attorney's Office is located in the Marin County Civic Center, Room 130, San Rafael, California. We are located on the first floor of the Hall of Justice wing. the direction are:

Southbound: Highway 101 take the North San/Pedro/Civic Center Drive exit. Turn left at the stoplight onto North San Pedro Road. Turn left at the stoplight onto Civic Center Drive. The Hall of Justice wing is located between the second and third archway. There is disabled, two-hour and all day parking available.

Northbound: Highway 101 take the Civic Center/North San Pedro Road exit. This is the first exist after Center San Rafael. At the first stop light turn left onto Civic Center Drive. The Hall of Justice wing is located between the second and third archway. There is disabled, two-hour and all day parking available.

What if I have a question which is not answered in your frequently asked questions?

You may call the District Attorney's Office between 8:00 a.m. and 4:30 p.m., Monday through Friday at (415)499-6450.

I was arrested/cited and released by a law enforcement agency. Can you tell me if the District Attorney filed charges against me? Can I have a copy of the police report?

To find out whether charges have been filed against you, please call (415)499-6450 for assistance. If you have been charged you or your attorney will receive a copy of your police report at your arraignment.

I am a defendant and I don't like the attorney who is representing me. Can I talk to you or one of your deputies about my case?

No. All attorneys are governed by a code of ethics which prevents them from speaking directly to anyone who has an attorney. As long as you are represented by an attorney, we may speak only to your attorney. Any question that you have about your case should be answered by your attorney.

I have been subpoenaed by the District Attorney to appear as a witness in a criminal case. Can I get witness fees? What if I can't attend on the date stated in the subpoena?

A subpoena is a court order directing you to be present at the time and place stated. The present witness fee is $12.00 per day. If you have a conflict with the date of the subpoena, you may call (415)499-6450. Have the name of the defendant and the date and time you are to appear available should there be any questions. Your call will be directed to the Subpoena Section.
